- Kinematica’s sole responsibility is, at its discretion, to repair, replace, or refund the purchase price of defective Products.
- Safety and Compliance: Customer must follow all safety instructions and regulations. Kinematica is not responsible for damages from non-compliance.

- Customer is solely responsible for ensuring the proper, safe, and legal operation of Products in their location.
- Liability: Kinematica is not liable for indirect or consequential damages. Total liability is limited to the purchase price.

- Intellectual Property: Kinematica owns all patents, trademarks, copyrights, and designs. Products may not be copied or modified without permission.

- Customers may not copy, reverse engineer, reproduce, modify, or distribute Products or any portion thereof without Kinematica’s prior written consent.
- Kinematica will, at its discretion, defend or settle claims of intellectual property infringement for Products it manufactures, provided the Customer promptly notifies Kinematica and provides reasonable assistance in the defense.
- Governing Law: Terms are governed by the laws of Bohemia, NY, USA. Disputes will be resolved by binding arbitration in Bohemia, NY.

- These Terms and Conditions are governed by and construed in accordance with the laws of the State of New York, USA, without regard to its conflict of law provisions.
- Any disputes or claims arising out of or relating to these Terms shall be exclusively resolved by binding arbitration in Bohemia, New York, administered by the American Arbitration Association.
- The prevailing party in any dispute shall be entitled to recover reasonable attorneys’ fees and costs.
